What is WPS and Why is it Important to Pennsylvania?

What does "WPS" mean?

WPS stands for Worker Protection Standard. Enforced by the Environmental Protection Agency, the WPS protects the health and safety of agricultural workers. The goal of WPS is to reduce injury and health risks for people who work with pesticides.

What is the Worker Protection Standard?

WPS requires employers to provide pesticide training that covers the following topics:

  • Pesticide product safety
    • Reading labels
    • Following directions
  • Pesticide application
    • Best health practices during application
    • Restricted Entry Intervals training
    • Posting signage to protect workers from entering areas that have been recently sprayed
  • Use of protective equipment
  • Pesticide handling
  • Decontamination practices

Who needs to comply with the WPS? 

  • Employers at Agricultural or commercial business that handle pesticides, including farms, forests, nurseries, and greenhouses.
  • Employers at Agricultural or commercial business with agricultural workers who work in places sprayed with pesticides within the last 30 days or have high-contact agricultural tasks like weeding, moving irrigation equipment, pruning, and harvesting.

What must I do to comply with the WPS?

You can complete WPS training for all of your employees using an EPA-approved video course.

Hawaiian Farm Pays $550,000 For Failure to Comply with Worker Protection Standards (WPS)

A Hawaiian Farm is accused of using a pesticide known as Lorsban Advanced incorrectly and failing to notify workers to avoid the field. Furthermore, the farm allegedly allowed and directed workers to enter the treated fields before an adequate amount of time had passed, without protective gear or access to decontamination supplies.

The Hawaii Department of Agriculture began an initial investigation in January of 2016 and deferred the case to the EPA for enforcement later that year. The EPA determined that the farm was in clear violation of the FIFRA Worker Protection Standard Regulations. In February of 2018 the farm reached an agreement with the EPA to pay $400,000 on eleven WPS training sessions and a $150,000 civil penalty.

Not only will the farm be required to provide $400,000 worth of Worker Protection Standard Trainings, but they must also develop compliance kits in 4 languages to accommodate the diverse populations of Hawaii, Guam, and the Northern Mariana Islands where the company has commercial farms.

Worker Protection Standard enforcement has not been widely advertised, however, as seen above, repercussions are steep and costly. Montana Pesticide Manufacturer Expanding Product Line

LAM International is growing. The company, based out of Butte, Montana, will expand production capacity and creating a new product, BoteGHA, which will control pests like whiteflies, aphids and thrips. It will be used on fruits, nuts, vegetables and other things. LAM International is building out its solid fermentation production. They are streamlining the production process and making it more automated.

In an email to the Montana Standard, a representative from the company said that there may be job openings for operators in the facility.

Their new product is made from fungi called beauverie bassiana GHA. It’s nontoxic and kills pests that land on surfaces, causing germination within the organism’s body and killing them from the inside. The product is safe for handlers as well as the general environment and other organisms. Its restricted entry interval (REI) is four hours.

LAM International manufactures and develops biopesticides and sells them to countries worldwide. It’s one of the most prominent biocide makers in the U.S.A. BoteGHA will be the company’s fifth insecticide.

The Montana deadline for renewal is December 31st. Certified applicators must earn 12 hours of continuing education per category, and qualifying applicators but earn 6 hours.

The Emerald Ash Borer, Beauty or Beast?

This iridescent metallic green beauty was first discovered in the Detroit area in 2002. Wooden packing materials are suspected to have been his preferred mode of transportation. The fact that they are smaller than a dime made it easy for them to hide within the wood products used to protect goods shipped overseas from China.

The Emerald Ash Borer has proven to be disastrous to Ash tree populations in the US and Canada. Despite their small stature (typically ½ inch long and 1/8 inch wide), they are quite capable of destroying ash trees thousands of times larger.

Adult females lay their eggs shortly after emerging in mid-to-late July, earlier if the weather becomes unseasonably warm. The eggs are extremely small (about 1/25th of an inch), reddish-brown in color and further develop into white larvae which are segmented and flat-headed. The larvae bore into the Ash trees, feeding under the bark and disrupting the tree's ability to transport the necessary water and nutrients throughout. You’ll often find their tracks visible underneath the bark of an affected tree. When this happens, the tree dies back and its bark begins to split.

It is estimated that tens of millions of Ash trees have been destroyed throughout the USA and Canada. Michigan alone has lost an estimated 40 million trees. The symptoms of the EAB are: thinning or dying of ash tree crowns, suckers at the base of the tree, splitting bark, tunneling under the bark, D-shaped exit holes, and woodpecker activity. Young trees die within one to two years after infestation and larger ones can live up to four years.

If you should notice symptoms of EAB infestation you should:

  • Call the USDA Emerald Ash Borer Hotline at 1-866-322-4512
  • Contact your local Animal Plant and Health Inspection Service (find contact info at USDA’s website HERE)
  • Buy your firewood from local sources and burn it where you buy it.
  • DO NOT move firewood from your property or across state lines.
  • Always buy kiln dried firewood.
  • Burn your leftover firewood before spring to eliminate the chance of infecting nearby live trees.

Michigan’s Skilled Trades Crisis

Plumbers, electricians, pipefitters, roofers, carpenters, ironworkers, glaziers and other skilled tradespeople are in high demand and short supply in Michigan. Shortages of unskilled workers are also on the rise.

 

Michigan isn’t the only state affected by a lack of skilled trades workers. It’s becoming increasingly difficult to fill vacant skilled labor positions throughout the entire United States.

 

A large part of the workforce problem stems from negative perceptions. Young people tend to view these professions as arduous and lacking opportunity for advancement.  High school students are encouraged to forego shop class in exchange for computer science and information technology. The elimination of vocational training in high school has played a major part in the reduction of skilled trades workers everywhere.

 

Help is on the horizon as Governor Rick Snyders “Marshall Plan for Talent” was announced in February 2018.  His plan is to spend more than $100 million over five years to reconstruct the way Michigan prepares its young people for the workforce.  Funding assistance programs are available through various agencies as Michigan Works, Veterans Administration, and American Indian Tribes. US Marine Corps Veteran Zachary Gage Naslund Receives Builders License Scholarship

Congratulations US Marine Corps Veteran Scholarship Recipient, Zachary Gage Naslund of Plymouth, Minnesota!

Zachary served in the United States Marine Corps as an Infantryman and received many awards and decorations, including a Marine Corps Good Conduct Medal, National Defense Service Ribbon, and a Global War on Terrorism Medal.

Before working construction, he logged many hours working for Habitat for Humanity. He built homes in the remote villages of Africa where he also performed an Eagle Scout project to build schools for villages that did not have enough funding to build them on their own.

Naslund stated in his scholarship application “I have always brought my knowledge on how to build to the people who need it most. I believe with this scholarship, I will be able to afford to take my state licensing exam and be able to use my license in a productive way to help others around me”
